By accessing or using the website at porthuenemefenceanddeck.com (the "Site") or by engaging Port Hueneme Fence & Deck ("Company," "we," "us," or "our") for any services, you agree to be bound by these Terms and Conditions. These Terms apply to all visitors to the Site and to all customers who enter into a service agreement with Port Hueneme Fence & Deck.
Port Hueneme Fence & Deck provides residential and commercial deck building, fence installation, patio cover construction, pergola installation, and related outdoor structure services in Port Hueneme, CA and the surrounding Ventura County area.
All services are subject to a separate written service agreement or contract that will be provided before any work begins. These Terms and Conditions apply in addition to that agreement. In the event of a conflict between these Terms and a signed written contract, the written contract controls.
We reserve the right to decline any project at our discretion.
Any estimate or quote we provide is based on the information available at the time it is prepared. Estimates are not binding contracts. A final price will be confirmed in a written service agreement before work begins.
Prices may change if the scope of work changes after an estimate is issued. This includes but is not limited to: changes requested by the customer, unforeseen site conditions discovered during work, or changes required to comply with building codes or permit requirements. We will notify you of any scope or price changes before proceeding with additional work.
All prices are in U.S. dollars. Prices do not include applicable sales tax, permit fees, or utility markout fees unless specifically stated in the written agreement.
Project start dates are estimates and may be affected by factors outside our control, including permit processing timelines, material availability, weather, or prior project completion.
If you need to cancel or reschedule a project, please notify us as soon as possible. Cancellations made after materials have been ordered or after a permit has been submitted may result in charges for costs already incurred, as specified in your written service agreement.
We reserve the right to reschedule or suspend work due to unsafe weather conditions, permit delays, or circumstances beyond our control without liability for such delays.
Payment terms will be set out in your written service agreement. Unless otherwise agreed in writing, a deposit is required before work begins, with the remaining balance due upon project completion or as specified in the written agreement.
Accepted payment methods will be specified in your service agreement. All invoices are due upon receipt unless other terms are agreed in writing. Overdue balances may be subject to late fees as specified in your service agreement.
California law gives contractors and suppliers the right to file a mechanics lien against your property if they are not paid. You may request a list of subcontractors and material suppliers used on your project. Failure to pay may result in a lien on your property.
Where required, Port Hueneme Fence & Deck will obtain the necessary building permits as part of the service. Permit fees are paid by the customer and will be included in your written estimate. We build to applicable California building codes and local amendments.
If you request that work be performed without required permits, we reserve the right to decline. We are not responsible for consequences arising from a customer's instruction to skip required permits.
Any workmanship warranty provided by Port Hueneme Fence & Deck will be specified in your written service agreement. Manufacturer warranties on materials are passed through to you as provided by the manufacturer.
Workmanship warranties do not cover damage caused by acts of nature, improper use or maintenance, modifications made by others, normal wear and tear, or conditions outside our control such as soil movement or moisture intrusion from other sources.
THE SITE AND ALL INFORMATION PROVIDED ON IT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
To the fullest extent permitted by law, Port Hueneme Fence & Deck shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of this Site or from the performance of services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or relating to these Terms or our services shall not exceed the amount you paid us for the specific service giving rise to the claim.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
You may use the Site for lawful purposes only. You may not use the Site to transmit any content that is unlawful, harmful, defamatory, or otherwise objectionable. You may not attempt to gain unauthorized access to any part of the Site or to any systems or networks connected to the Site.
All content on the Site, including text, images, and logos, is owned by or licensed to Port Hueneme Fence & Deck and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written permission.

If a dispute cannot be resolved informally, the parties agree to attempt mediation before pursuing any other legal remedy. Any unresolved claims shall be submitted to binding arbitration in Ventura County, California, under the rules of a mutually agreed arbitration provider, except that either party may seek emergency injunctive relief from a court of competent jurisdiction.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising from or relating to these Terms that is not subject to arbitration shall be brought exclusively in the state or federal courts located in Ventura County, California.
We reserve the right to update or modify these Terms at any time. Changes will be effective when posted to this page with a revised effective date. Your continued use of the Site or our services after any changes constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
